1.1. The Owner offers to you a variety of Products including but not limited to hijab, scarfs, hijab pins, masks, mask extenders, and such other garments / accessories.
1.2. The Owner shall endeavour to provide an accurate description of the Products on the Website, however, it does warrant complete and continuous accuracy in such description. If you receive a Product which is inaccurate as per the description provided on the Website, the only remedy available to you is to write to the Grievance Officer or request for return of the same (as per the Return and Refund Policy)
2.1. The pricing of the Products as displayed on the website is inclusive of all taxes and exclusive of the shipping charges, and the grand total (including the shipping charges) is displayed only after the Product is added to the cart.
2.2. The Shipping charges as displayed on the Website include the packaging charges as well as the courier charges (India Post Registered Parcel Service used by the Owner), however, if any other Courier Service, as preferred / requested by you, is used then you shall have to pay the additional / requisite courier charges for the same.
2.3. The Owner shall endeavour to provide an accurate pricing of the Products, however, if a Product is erroneously mispriced and is delivered to you at such price, the Owner shall refund the excess amount to you, if any, or you shall pay the deficit amount to the Owner, if any.
2.4. The Owner may, at its discretion change / update the pricing of the Products as displayed on the Website without providing any notice or intimation to you.
3.1. For placing an order of any Product, you are required to enter your details such as Name, Address, etc., and the Owner shall, upon verification of your credentials, either accept or reject the order at its discretion.
3.2. If the Owner accepts your order, it shall get back to you with the details of its bank account for the payment of said Order. No Cash on Delivery is available.
3.3. Upon such payment made by you, the Owner shall further verify your credentials as well as the payment made by you, and at its discretion, either confirm or reject the order placed by you even at this stage. If the order is rejected, the entire amount shall be refunded to you as per the Return and Refund Policy.
3.4. If the order is confirmed by the Owner, it shall endeavour to dispatch the Product to the shipping address provided by you on the Website, within 3 days of this confirmation of the order, however, the same may be delayed owing to reasons beyond the Owner’s control. If it is not possible to deliver the Product to a particular destination, the Owner may reject the same.
3.5. Upon dispatch of the Product, the Owner shall share the Tracking Id with you and it shall be your responsibility to track the status of the same.
3.6. The Owner shall process only one shipping address per order, so if several items are purchased at different shipping addresses under one order number, each order shall be counted as a separate order.
3.7. The Product shall be dispatched and delivered through India Post (Registered Parcel) Service, however, the Owner may take your suggestion for any other Courier Service preferred by you, and the shipping charges as per clause 2.2 shall have to be paid by you. The Courier Delivery Person shall attempt delivery of the Products at your shipping address for a maximum of 1 time, after which, it is your responsibility to track the Products and procure the same from the said Courier Service.
3.8. In case it is not possible to deliver the Product(s) owing to your non-availability at the shipping address or owing to your house door being locked or such other reason, and the same is returned to the Owner, the refund, if any, shall be processed as per the Return and Refund Policy.
3.9. If the Product as received by you from India Post Postmen/Courier Delivery Person at your door-step, appears to be damaged, tampered, or with a broken seal, kindly do not accept the Product and return it immediately to the Postmen/Courier Delivery Person in front of you. If you accept the Product without checking, no return, exchange, refund, or grievance redressal option shall be available to you.
3.10. If the Product is displayed as ‘unavailable’, it means that the Product is not in stock and the Owner does not guarantee that the same would be made available again.
3.11. The Owner does not ship the Product(s) outside the Republic of India.
4.1. You shall not copy or make duplicate copies of the Product that is purchased by you through this Website, without the consent of the Owner.
4.2. You shall not sell or rent or use for any commercial purposes, the Product purchased through this Website to any person and / or entity, without the consent of the Owner.
5.1. The Owner disclaims any guarantees of exactness, accuracy and correctness as to the finish, appearance, size, colour, and any other description of any Product displayed on this Website.
5.2. The Owner shall not be liable for any loss or damage caused to any person and / or entity owing to erroneously mispricing of any Product displayed on this Website.
5.3. The Owner shall not be liable for any loss or damage caused to any person and / or entity owing to the usage of any Product, including but not limited to any allergies, rashes, skin problems, suffocation, and such other problems.
5.4. The Owner shall not be liable for any loss or damage caused to any person and / or entity due to any delay in delivering any Product owing to reasons beyond the Owner’s control.
5.5. The Owner shall not be liable for any loss or damage caused to any person and / or entity owing to the acts or omissions of the Postmen/Courier Delivery Persons during, and out of the course of shipping and delivery of any Product.
You shall indemnify, defend and hold harmless the Owner for any loss or damage caused to any person and / or entity as a consequence of your acts or omissions.
7.1. All grievances with respect to the access or usage of the Products shall be addressed by Mrs. Mushira Shaikh (Grievance Officer) and you are insisted to write to her regarding any such grievance, on email@example.com, or WhatsApp or text message her on +919004929161.
7.2. The Grievance Officer shall endeavour to get back to you within 5 working days of receipt of your communication, and the redressal / closure of your issue shall be done at the earliest.
Any dispute between the Parties during and / or out of course of; arising out of; and / or as a consequence of this Terms and Conditions shall be promptly intimated by the disputing Party to the other Party, and the same shall be amicably resolved by the Parties within further 25 days. Either Party may, in the event that such dispute is not resolved amicably, issue a Notice of 15 days to the other Party for resolving the same by Arbitration proceedings governed by the Arbitration and Conciliation Act, 1996 and the venue for the same shall be at Mumbai, Maharashtra.
The Terms and Conditions, and the aforesaid process of dispute shall be governed and construed in accordance with the laws of Republic of India and are subject to the exclusive jurisdiction of Competent Courts at Mumbai, Maharashtra.
